Superman flies off album cover

Another copyright/trademark infringement issue based on a cd cover design. This time it's the Man of Steel. Artist Sufjan Stevens' cd release, Illinois, contained an image of the chicago skyine with Superman flying above. On legal advice, Stevens' label, Asthmatic Kitty has asked retailers not to sell the cds, and there is no word on a release date for the newly designed cd.

The "Fair Use" legal argument probably don't fly here... bad pun.
